Eversheds Sutherland Partner Issa Hanna shares his insights with Private Equity Law Report about the SEC’s recent Risk Alert addressing its Marketing Rule.
Issa noted that although private fund managers are not specifically acknowledged in the section of the Risk Alert discussing the types of deficiencies as to general prohibitions that are listed in the Risk Alert, they are generic enough that private fund managers would be well advised to review them.
“Much of the Risk Alert – and particularly the section on general prohibitions – really highlighted tactics and practices that could occur at any type of firm," Issa said.
